沅陵(ling)縣持續推進(jin)興建(jian)品(pi𓆉n)牌房“拿到自(zi)己的新房子即交證”制度改革頒(ban)布方案設計

為認(ren)真貫徹中央、省、市關于(yu)深化“放管服”改革的精神(shen),進(jin)一(yi)步優化營(ying)商(shang)環境,構建(jian)房地產規范管理(li)長效(xiao)機制(zhi),根據《湖南(nan)省人(ren)民政(zheng)府(fu)辦(ban)公廳(ting)關于(yu)印(yin)發(fa)<湖南(nan)省推進(jin)新建(jian)商(shang)品(pin)房“交(jiao)房即(ji)交(jiao)證”改革實(shi)(shi)施(shi)方(fang)案>的通知》(湘政(zheng)辦(ban)發(fa)〔2021〕75號)、《懷化市人(ren)民政(zheng)府(fu)辦(ban)公室關于(yu)印(yin)發(fa)〈懷化市推進(jin)新建(jian)商(shang)品(pin)房“交(jiao)房即(ji)交(jiao)證”改革實(shi)(shi)施(shi)方(fang)案〉的通知》(懷政(zheng)辦(ban)發(fa)〔2022〕25號)文件(jian)要求,結(jie)合我縣實(shi)(shi)際,🎶制(zhi)定(ding💝)本實(shi)(shi)施(shi)方(fang)案。

一、總的特殊要求

(一)考核評價思(si)想觀念。保(bao)持不懈以(yi)(yi)辛(xin)鳴新黃金時代全(quan)國獨特(te)社(she)會上理性主義價值(zhi)觀為指導性,保(bao)持不懈以(yi)(yi)大家(jia)為公(gong)司(si)的未來(lai)發展價值(zhi)觀,集聚在建商品(pin)銷售房(fang)(fang)(fang)“拿到自(zi)己的新房(fang)(fang)(fang)子長期的交不了解證”問題,以(yi)(yi)工(gong)(gong)程建筑倡(chang)導該項目審查措施(shi)體(ti)(ti)制改革為切入點,開通堵點和(he)重中之重方面,精準發力倡(chang)導“相關(guan)部們主體(ti)(ti)、部們監督和(he)工(gong)(gong)廠主責、挑選(xuan)心儀的房(fang)(fang)(fang)子人(ren)緊密配(pei)合”的重任標(biao)準體(ti)(ti)系,日(ri)益保(bao)證 重建貨(huo)品(pin)房(fang)(fang)(fang)“接房(fang)(fang)(fang)即(ji)交證”“住(zhu)權與土(tu)地使用(yong)權同(tong)步軟件”,提高各族人(ren)民百姓的♏獲得(de)了感(gan)和🍨(he)令人(ren)服務質量。

(二)改草對方。將交(jiao)(jiao)(jiao)(jiao)房(fang)(fang)時(shi)間作(zuo)💮(zuo)為新建(jian)商品房(fang)(fang)“交(jiao)(jiao)(jiao)(jiao)房(fang)(fang)即(ji)交(jiao)(jiao)(jiao)(jiao)證(zheng)”改革工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)的關鍵時(shi)間節(jie)點,全面落實“交(jiao)(jiao)(jiao)(jiao)房(fang)(fang)即(ji)交(jiao)(jiao)(jiao)(jiao)證(zheng)”工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)機制,建(jian)立交(jiao)(jiao)(jiao)(jiao)房(fang)(fang)與交(jiao)(jiao)(jiao)(jiao)證(zheng)聯動機制,將現(xian)行房(fang)(fang)屋工(gong)(gong)(gong)(gong)(gong)程竣工(gong)(gong)(gong)(gong)(gong)驗(yan)收后、不動產首(shou)次登(deng)記(ji)(ji)(棟證(zheng))之前的流程前置(zhi)到(dao)工(gong)(gong)(gong)(gong)(gong)程竣工(gong)(gong)(gong)(gong)(gong)驗(yan)收備(bei)(bei)案(an)(an)前,確保完成(cheng)工(gong)(gong)(gong)(gong)(gong)程竣工(gong)(gong)(gong)(gong)(gong)驗(yan)收備(bei)(bei)案(an)(an)即(ji)具備(bei)(bei)辦理首(shou)次登(deng)記(ji)(ji)條件;在完成(cheng)工(gong)(gong)(gong)(gong)(gong)程竣工(gong)(gong)(gong)(gong)(gong)驗(yan)收備(bei)(bei)案(an)(an)后20個工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)日內,由(you)房(fang)(fang)地產開(kai)發企業組織(zhi)交(jiao)(jiao)(jiao)(jiao)房(fang)(fang),自然(ran)資源(yuan)主管部門依申請(qing)為購房(fang)(fang)人辦理轉移登(deng)記(ji)(ji)(分戶(hu)證(zheng)),實現(xian)購房(fang)(fang)人“收房(fang)(fang)即(ji)拿(na)證(zheng)”。

(三)施工條(tiao)件不(bu)能間

1.自(zi)2022年12月31日起,通(tong)過招(z♌hao)拍掛(gua)等方式取得(de)國有建(jian)設用(yong)地(di)使用(yong)權(quan⛦)的新建(jian)房地(di)產項目;

2.自2022年12月31日起,新取(qu)得商品房預售許可證的房地產項目;

3.本方(fang)式具(ju)體實施(shi)(shi)前,已(yi)具(ju)有改(gai)建菜品種(zhong)類房預售經營(ying)許可(ke)證經營(ying)許可(ke)證證相結行(xing)產(chan)品,但未能對其進行(xing)菜品種(zhong)類房交工的房房產(chan)公(gong)(gong)(gong)司工程,如施(shi)(shi)工時間(jian)進展(zhan)情(qing)況(kuang)、檢收手續費(fei)等符(fu)合符(fu)合要(yao)(yao)求(qiu)拿(na)房子即交證工作上(shang)符(fu)合要(yao)(yao)求(qiu)的,對應(ying)單位(wei)部門(men)應(ying)積極態度宣傳(chuan)方(fang)案引(yin)導系統,鼓勁房房產(chan)公(gong)(gong)(gong)司定制開發企業(ye)公(gong)(gong)(gongꦺ)司公(gong)(gong)(gong)開化申請注(zhu)冊定為(wei)拿(na)房子即交證時間(jian)范圍。

(四)方案具體條件

1.拿房前提。房(fang)地(di)產激發(fa)的行(xing)業(ye)激發(fa)各個企業(ye)交樓的農村(cun)(cun)房(fang)屋建筑(zhu)需已進行(xing)水利工(gong)程建筑(zhu),完工(gong)了綜合質量檢查🉐優(you)秀,進行(xing)完工(gong)了質量檢查登(deng)(deng)記表備案(an);無包涵建設項目整宗圣土的封禁、任何(he)任何(he)抵(di)押物(wu)物(wu)或需轉(zhuan)(zhuan)意登(deng)(deng)記表備案(an)農村(cun)(cun)房(fang)屋建筑(zhu)的任▨何(he)任何(he)抵(di)押物(wu)物(wu)、封禁等政治權利受(shou)限制;土地(di)權清洗無質疑且已要(yao)具備辦不能(neng)特定(ding)物(wu)轉(zhuan)(zhuan)意登(deng)(deng)記表備案(an)必備條(tiao)件(jian)。

2.交證必備條件。個人申(shen)批(pi)辦(ban)好🤡(hao)營(ying)業執照的住房(fang)需要以達到拿房(fang)因(yin)素;歸屬權(quan)不清無爭執;個人申(shen)批(pi)辦(ban)好(hao)遷移變更登記(ji)的材料非常完整;做好(hao)房(fang)屋契稅等(deng)相應所得稅核(he)實。

二、事情重任

(一(yi))調低優化提升找人(ren)辦(ban)事頁面(mian)。進(jin)三步切(qie)實加(jia)強總停產登計宗(zong)合(he)批準(zhun)界(jie)面(mian)和(he)本職(zhi)工(gong)作(zuo)投(tou)(tou)建網(wang)站建設(she)(she)(she)(she)建設(she)(she)(she)(she)項目批準(zhun)宗(zong)合(he)服(fu)務(wu)(wu)(wu)(wu)質(zhi)(zhi)量(liang)的(de)(de)(de)的(de)(de)(de)培訓界(jie)面(mian)投(tou)(tou)建,在這(zhe)個(ge)依據上(shang)確定“一(yi)家環節圖、一(yi)家控制試行”的(de)(de)(de)規定,建立個(ge)人(ren)信息遠程管(guan)理、聯(lian)席批準(zhun)策(ce)略(lve),滿(man)足“交(jiao)(jiao)(jiao)付(fu)(fu)即交(jiao)(jiao)(jiao)證(zheng)”本職(zhi)工(gong)作(zuo)與本職(zhi)工(gong)作(zuo)投(tou)(tou)建網(wang)站建設(she)(she)(she)(she)建設(she)(she)(she)(she)項目批準(zhun)關(guan)與地方無機融入,確保水、電(dian)、氣、線(xian)上(shang)、電(dian)視機等(deng)開通賬(zhang)戶業務(wu)(wu)(wu)(wu)部(bu)門(men)聯(lian)動機制辦(ban)好(hao)。縣(xian)政(zheng)務(wu)(wu)(wu)(wu)服(fu)務(wu)(wu)(wu)(wu)質(zhi)(zhi)量(liang)的(de)(de)(de)幼(you)兒(er)園服(fu)務(wu)(wu)(wu)(wu)質(zhi)(zhi)量(liang)的(de)(de)(de)的(de)(de)(de)培訓中心的(de)(de)(de)考核評價(jia)縣(xian)當然教育環境(jing)資源(yuan)局(ju)(ju)(ju)在政(zheng)務(wu)(wu)(wu)(wu)服(fu)務(wu)(wu)(wu)(wu)質(zhi)(zhi)量(liang)的(de)(de)(de)幼(you)兒(er)園幼(you)兒(er)園新投(tou)(tou)入貨物(wu)房“交(jiao)(jiao)(jiao)付(fu)(fu)即交(jiao)(jiao)(jiao)證(zheng)”服(fu)務(wu)(wu)(wu)(wu)質(zhi)(zhi)量(liang)的(de)(de)(de)的(de)(de)(de)培訓界(jie)面(mian),縣(xian)當然教育環境(jing)資源(yu꧅an)局(ju)(ju)(ju)主管(guan)寫(xie)好(hao)“交(jiao)(jiao)(jiao)付(fu)(fu)即交(jiao)(jiao)(jiao)證(zheng)”重要性方案(an)資訊和(he)幫助服(fu)務(wu)(wu)(wu)(wu)質(zhi)(zhi)量(liang)的(de)(de)(de)的(de)(de)(de)培訓。(主辦(ban)行標準(zhun):縣(xian)政(zheng)務(wu)(wu)(wu)(wu)提供服(fu)務(wu)(wu)(wu)(wu)提供服(fu)務(wu)(wu)(wu)(wu)核心,主責標準(zhun):縣(xian)很(hen)自然市(shi)場局(ju)(ju)(ju)、縣(xian)住建局(ju)(ju)(ju))

꧙(二(er))組合塑造金融產品具體流(liu)程(cheng)。梳理(li)記(ji)(ji)錄簿(bu)證與(yu)安全(quan)管理(li)的關心(xin),假設按照內置這批(pi)(pi)、串聯(lian)這批(pi)(pi)、簡(jian)略這批(pi)(pi)和后攝(she)這批(pi)(pi)的特殊要求,對商品價格房轉賣(mai)、工程(cheng)💮竣工檢收(shou)檢收(shou)、申辦不變產初次記(ji)(ji)錄簿(bu)證及(ji)變動記(ji)(ji)錄簿(bu)證等全(quan)方(fang)法進行(xing)優(you)化(hua)提升(sheng)優(you)化(hua)提升(sheng)。

1.項目建設轉賣階段中

(1)嚴把預(yu)售(shou)(shou)入口關(guan)。ꦰ嚴格執行預(yu)售(shou)(shou)標準和條件,在(zai)辦理商品(pin)房預(yu)售(shou)(shou)許可時(shi),應依法(fa)(fa)審查是否取得(de)國(guo)有建(jian)設用(yong)地(di)使用(yong)權(quan)、建(jian)設工程規(gui)劃(hua)許可證和建(jian)筑(zhu)工程施工許可證,對土地(di)權(quan)屬存在(zai)抵押、查封等限(xian)制情況或(huo)改(gai)變規(gui)劃(hua)用(yong)途、超(chao)規(gui)劃(hua)紅線等違法(fa)(fa)行為(wei),在(zai)產(chan)權(quan)限(xian)制未(꧟wei)解(jie)除或(huo)違法(fa)(fa)行為(wei)未(wei)處理完成前(qian),不得(de)核(he)發(fa)商品(pin)房預(yu)售(shou)(shou)許可證。督促(cu)房地(di)產(chan)開發(fa)企業按照“交房即交證”有關(guan)程序和要求,做好相關(guan)準備工作。(重任機構:縣住建局)

(2)全面實行預(yu)(yu)售(shou)合(he)(he)同(tong)(tong)(tong)網簽(qian)備案(an)。商品(pin)(pin)房(fang)(fang)預(yu)(yu)售(shou)時,房(fang)(fang)地產(chan)開發企(qi)業與購房(fang)(fang)人達成(cheng)一致后網上簽(qian)訂預(yu)(yu)售(shou)合(he)(he)同(tong)(tong)(tong),系(xi)統自(zi)動核驗,一鍵生(sheng)成(cheng)電(dian)子合(he)(he)同(tong)(tong)(tong),并實時推(tui)送(song)至不動產(chan)登記機(ji)構(gou)、稅(shui)務(wu)(wu)部門(men)、金融機(ji)構(gou)和(he)(he)水、電(dian)、氣、網絡、電(dian)視等服(fu)務(wu)(wu)單位。完(wan)善標準化商品(pin)(pin)房(fang)(fang)預(yu)(yu)售(shou)合(he)(he)同(tong)(tong)(tong)范(fan)本,明確交房(fang)(fang)時間(jian)、條件(j🔥ian)和(he)(he)雙方權(quan)利義(yi)務(wu)(wu),確保(bao)房(fang)(fang)地產(chan)開發企(qi)業交付的房(fang)(fang)屋竣工聯(lian)合(he)(he)驗收合(he)(he)格(ge)、完(wan)成(cheng)工程竣工驗收備案(an)、權(quan)屬清晰無(wu)爭(zheng)議(yi)且(qie)已具備辦理不動產(chan)轉移(yi)登記條件(jian)。合(he)(he)同(tong)(tong)(tong)義(yi)務(wu)(wu)履行情況納入房(fang)(fang)地產(chan)市(shi)場(chang)監(jian)管和(he)(he)誠信管理范(fan)圍。(主辦行(xing)計量機(ji)關單位:縣(xian)住建局,責任(ren)書計量機(ji)關單位:縣(xian)稅收(shou)局、各族人民中國銀行(xing)沅陵(ling)縣(xian)支行(xing)、縣(xian)自然❀環境生態(tai)資源局、各縣(xian)市場管控局)

(3)大力推(tui)行預(yu)(yu)告登(deng)記(ji)(ji)(ji)。對預(yu)(yu)售商(shang)品房(fang)(fang)(fang)(fang)全(quan)面(mian)開展預(yu)(yu)告登(deng)記(ji)(ji)(ji),推(tui)動(dong)預(ꦑyu)(yu)售商(shang)品房(fang)(fang)(fang)(fang)合同(tong)(tong)備案與預(yu)(yu)告登(deng)記(ji)(ji)(ji)協同(tong)(tong)辦(ban)理,實現同(tong)(tong)步申請、一窗受理、并行聯辦(ban)、實時(shi)共享。探索開展預(yu)(yu)告登(deng)記(ji)(ji)(ji)和(he)轉(zhuan)移、抵押登(deng)記(ji)(ji)(ji)合并申請,由房(fang)(fang)(fang)(fang)地產開發企業(ye)在預(yu)(yu)告登(deng)記(ji)(ji)(ji)時(shi)同(tong)(tong)步收(shou)集新建商(shang)品房(fang)(fang)(fang)(fang)轉(zhuan)移、抵押登(deng)記(ji)(ji)(ji)的相(xiang)關材(cai)料。已🌱辦(ban)理預(yu)(yu)告登(deng)記(ji)(ji)(ji)的,在辦(ban)理轉(zhuan)移、抵押登(deng)記(ji)(ji)(ji)時(shi),有(you)關材(cai)料直接沿用,不再重復收(shou)取。(統籌協調工(gong)作單位名稱:꧅縣(xian)肯定(ding)物資局(ju),責任(ren)狀工(gong)作單位名稱:縣(xian)住建局(ju)、縣(xian)財務局(ju)、公民(min)商業銀行沅陵縣(xian)支行)

2.工程竣工質量檢查質量檢查關鍵時期

(1)前(qian)置相關測(ce)繪流程。將不動產權屬調查和土地、規劃、房產測(ce)繪流程前(qian)置到(dao)竣(jun)工聯(lian)合(he)驗收之(zhi)前(qian),按(an)照“多測(ce)合(he)一”改革要求做好測(ce)量、測(ce)繪成果審核入(ru)庫,直(zh🉐i)接(jie)作為聯(lian)合(he)驗收和不動產登記的申請材料(liao)。(通力(li)協(xie)作政府(fu)部(bu)門ꦬ(men):縣(xian)自然的的資源局,職責政府(fu)部(bu)門(men):縣(xian)住建局)

(2)嚴(yan)格實(shi)(shi)行(xing)(xing)聯(lian)合驗收(shou)(shou)。嚴(yan)格執(zhi)行(xing)(xing)全(quan)省統一的房(fang)屋建(jian)筑和市政(zheng)基礎(chu)設(she)施工程竣工聯(lian)合驗收(shou)(shou)辦法,落(luo)實(shi)(shi)驗收(shou)(shou)事項(xiang)(xiang)、流程、時(shi)限、材料等方(fang)面的要求(qiu),實(shi)(shi)行(xing)(xing)規(gui)劃、土地、消(xiao)防(fang)、人(ren)防(fang)、城建(jian)檔(dang)案(an)等事項(xiang)(xiang)限時(shi)聯(lian)合驗收(shou)(shou),統一出具驗收(shou)(shou)意見。嚴(yan)格執(zhi)行(xing)(xing)全(quan)省工程建(jian)設(she)項(xiang)(xiang)目審批制度改(gai)革規(gui)定的竣工驗收(shou)(shou)備案(an)所需(xu𝓡)材料清單。推(tui)動將消(xiao)防(fang)驗收(shou)(shou)要求(qiu)納入(ru)施工過(guo)程質量安全(quan)監管體(ti)系(xi),推(tui🤡)進規(gui)劃條件(jian)和用(yong)地條件(jian)的施工過(guo)程監管,強(qiang)化過(guo)程監管和過(guo)程糾偏(pian)。(加強(qia🎉ng)組織(zhi)領導(dao)基(ji)層(ceng)(ceng)單位名(ming)稱:縣住建局,承擔的(de)責任基(ji)層(ceng)(ceng)單位名(ming)稱:縣自然環境資(zi)源꧃局)

(3)并行開展核(he)實核(h𝔉e)算。在竣工(gong)驗收階段,ജ嚴格按照規劃設計指(zhi)標核(he)實相關數(shu)(shu)據,做(zuo)好有關“期轉現(xian)”數(shu)(shu)據核(he)實、土地指(zhi)標核(he)算、物業管理用房(fang)確(que)認等(deng)工(gong)作。💙(領導公(gong)司(si):縣自然的資源(yuan)共(gong)享(xiang)局(ju),工(gong)作公(gong)司(si):縣住建🌜局(ju))

標準涉及到的增值稅(shui)的選擇、清繳(jiao)或歸集,在竣工(gong)檢查🔜(cha)驗(yan)收檢查(cha)驗(yan)收周期(qi)(qi)依(yi)照相關要求按期(qi)(qi)完整士地工(gong)程款、報建費(縣(xian)(xian)(xian)城基礎知(zhi)識(shi)裝(zhuang)置一體化費、水土(tu🐻)堅持費、民(min)防費)、物業公司保修金額的選擇、清繳(jiao)或歸集,在不變產(chan)第一回和更換核查(cha)時就(jiu)不再進行審核。(領頭的基層單位:縣(xian)(xian)(xian)稅(shui)務局(ju)、縣(xian)(xian)(xian)財政資金局(ju),工(gong)作的基層單位:縣(xian)(xian)(xian)很自然影視(shi)資源局(ju)、縣(xian)(xian)(xian)住(zhu)建局(ju))

(4)簡化土地(diꦑ)指(zhi)標核(he)(he)算程序(xu)。在(zai)符(fu)合國土空間(jian)規劃的前(qian)提下,對項目實測后土地(di)面積或(huo)建筑規模(mo)與出(chu)(chu)讓(rang)合同(tong)存在(zai)差異,需核(he)(he)算指(zhi)標修改土地(di)出(chu)(chu)讓(rang)合同(tong)的,由(you)房(fang)地(di)產開發企業與自然資(zi)源主(zhu)管部門簽訂補(bu)充(chong)協議,補(bu)繳相關價款(kuan)及稅費,再申(shen)請不動產登記。(領導(dao)方:縣(xian)自然(ran)環(huan)境成本局(ju),權責方:縣(xian)住建局(ju)、縣(xian)財務局(ju)、縣(xia༺n)稅收局(ju))

(5)積極推行(xing)施(shi)工(gong)(gong)(gong)(gong)過程(cheng)(cheng)結算(suan)(suan)和(he)告知(zhi)承諾制。積極推進(jin)施(shi)工(gong)(gong)(gong)(gong)過程(cheng)(cheng)結算(su💙an)(suan),對約定結算(suan)(suan)節點(dian)內完成的質量合格工(gong)(gong)(gong)(gong)程(cheng)(cheng)內容,即(ji)時開展工(gong)(gong)(gong)(gong)程(cheng)(cheng)價款計算(suan)(suan)、調整(zheng)、確認及支付(fu)等(deng)(deng)。將(jiang)“竣(jun)工(gong)(gong)(gong)(gong)結算(suan)(suan)備(bei)案”和(he)“建(jian)設工(gong)(gong)(gong)(gong)程(cheng)(cheng)檔(dang)案歸檔(dang)”等(deng)(deng)事項調整(zheng)到竣(jun)工(gong)(gong)(gong)(gong)驗收(shou)備(bei)案后,加(jia)快(kuai)不動產首次(ci)登記辦理(li)。房地產開發企業(ye)應在承諾期內補齊相關材料,對存在失信(xin)行(xing)為的,依(yi)法依(yi)規進(jin)行(xing)行(xing)政處理(li)及信(xin)用懲(cheng)戒。(通力協作機關政府部門(men):縣住建(jian)局,權利與義(yi)務機關政府部門(men):縣財政部門(men)局、縣天然(ran)的大💞自然(ran🦋)資源局)

3.接房交證關鍵時期
